He has twenty four years’ experience in dealing with a wide variety of property disputes involving both commercial and residential property.

Russell advises a number of high profile clients including national house builders and telecommunications companies on all aspects of development and commercial landlord & tenant disputes. His areas of expertise also include disputed break clauses, dilapidations claims, commercial lease renewal, rights of way, rights to light, adverse possession, restrictive covenants, boundary issues and contested leasehold enfranchisement.

Recent work highlights include:

  • Advising a well known aggregates company in relation to a land heave event on neighbouring land as a result of alleged excessive stockpiling of material on the client’s land.
  • Acting for a national newspaper in relation to a disputed guarantee and break clause on a leasehold property that it had assigned to another company which subsequently went into liquidation.
  • Acting for a group of top floor tenants in pursuing a claim against the freeholder of a block of flats who planned to add another storey on to the top of the building, above their flats.
  • Acting for a property developer in connection with resisting a claim brought by a neighbouring landowner in the First Tier Tribunal for a prescriptive (long use) right of way over the developer’s land and which would compromise its development plans.
