One of the most challenging legal issues that a potential developer of land can face is in relation to restrictive covenants. The law is extremely complex and in many cases archaic. This seminar is designed to provide practical advice and guidance on the various ways in which restrictive covenants can be challenged, discharged, modified, or insured against.

Joshua Dubin, barrister at 3 Paper Buildings chambers in Oxford, will talk about the various legal methods open to a developer to challenge the enforceability of a restrictive covenant in court, or apply to the Upper Tier Tribunal (Lands Chamber) to either discharge or modify a covenant.

Joshua Dubin is a specialist property lawyer. He provides advocacy and advice on litigation principally in the High Court and County Court, but he also appears in the First-Tier and Upper Tribunals. Joshua’s property practice includes familiar property work, such as neighbour disputes (boundaries, restrictive covenants, nuisance, rights of way), and the full range of residential and commercial landlord & tenant matters. He also accepts instructions in property law more broadly, such as applications under TOLATA 1996, mortgages, commons and agricultural tenancies.

Tiko Rawlinson-Winder, Underwriting & Centre Manager at Zurich Insurance, will present a supplemental talk about the process of obtaining indemnity insurance cover in relation to restrictive covenants and the options available to developers.
