Insurance disputes

The Dispute Resolution service acts for companies and individual policy holders in relation to disputes with insurers. Advice and support is also provided to insurance brokers that consider a client is being disadvantaged by a wrongful stance taken by the insurer to decline cover or avoid the policy.

All of the team members dealing with these types of claims have considerable experience of handling disputes where insurers have alleged fraud, breach of warranty or condition precedent, or where there has been a material non-disclosure. Work also regularly includes interpretation of exclusion clauses.

Claims may be more appropriate for the Financial Ombudsman than court, and at an early stage it may be that the appointment of a dedicated policy holder's loss adjuster is recommended before incurring potentially significant legal costs. The service regularly advises on potential options and alternatives and where necessary makes appropriate referrals.
