Boyes Turner’s specialist Industrial Disease team were instructed by Mr S, a tiler, who was diagnosed with mesothelioma.
Mr S recalled a period where he was employed by Bellini as a tiler from 1963 to 1964. He worked on the large new Heinz headquarters in Hayes in Middlesex. He worked in close proximity to laggers who were lagging the pipes with asbestos lagging. He was young at the time and fascinated by the work of laggers and how they moulded the asbestos lagging onto the pipes. He watched as they mixed up the asbestos paste. Mr S watched them pour powder asbestos into containers to be mixed up prior to use. This caused clouds of dust. Mr S worked in that dusty environment. Mr S joined the laggers in the canteen at breaks. He sat next to and chatted to the laggers as he was interested in the work that they were doing.
Despite extensive searches, no insurers were traced for his employer Bellini. In those circumstances and in the absence of an insurer we made a successful application on Mr S’s behalf under the Diffuse Mesothelioma Payment Scheme. Based on Terry’s age at diagnosis, he was eligible for a gross payment of £153,323.
