Our client underwent a cataract removal operation through a private healthcare company that was contracted by the NHS to undertake the surgery to help reduce waiting lists. During surgery, her eye was damaged, leading to partial loss of vision which required further surgery, including repositioning of the iris. Following the remedial surgery, her vision did not improve and she was left with some visual disability.
Court proceedings were issued against the company responsible for the surgery, and the surgeon who had performed the operation. The defendants denied responsibility (liability) for our client’s injury. The case proceeded but when the defendants were unable to produce evidence to justify their continued denial of liability, we were able to reach a negotiated out-of-court settlement.
