Settlement for family of hairdresser with mesothelioma

Boyes Turner’s specialist Mesothelioma and Asbestos Disease Claims team have successfully concluded a DMPS case on behalf of the family of the late Carol*, who sadly died from mesothelioma in September 2022.

Carol, who lived in Essex, worked as a hairdresser in 1964 until around 1971. She worked for two different hairdressers and completed her three-year hairdressing apprenticeship with one of them. Both hairdressers appeared on her employment history schedule. Carol’s employers were the individuals who employed her, they were not incorporated businesses.

 

We were unable to locate employer’s liability insurance for the period of Carol’s employment. The individuals who employed Carol were no longer trading and there was therefore no entity to pursue.

Carol described that she encountered asbestos when using the old-fashioned hairdryers and when cleaning them out. Carol would clean them out using a cloth or a brush. She could see the dust in the air as she was cleaning out the hairdryers, which had elements within them containing asbestos. Carol cleaned these out regularly and was exposed to asbestos dust as a result. She was not provided with any respiratory protection.

 

As there was no entity to pursue, we made an application on Carol’s behalf under the Diffuse Mesothelioma Payment Scheme (DMPS), which allows individuals with mesothelioma to claim compensation when there is no company or employer’s liability insurance to claim from.

 

Carol sadly died before her application concluded. Compensation through the DMPS scheme was therefore paid into Carol’s Estate.

 

The amount awarded to Carol’s family under the DMPS scheme was based on Carol’s age when she was diagnosed with mesothelioma.
