Special Educational Needs and Disability (SEND), Mental Capacity and Family Law: What you Need to Know

Family cases involving children and young people with SEND often feature added complexity, beyond the remit of family courts. Mencap and Public Health England identified 353,000 children as having a learning disability (2016) and with divorce rates sharply rising since 2020, the need to understand the overlap between SEND, family and mental capacity law is essential.

On 29 June 2023, 3PB family and education law barrister, Aimee Fox, teamed up with Paul Linsell, Partner and Head of Boyes Turner’s family law team, along with James Pantling-Skeet and Rachael Allison, Senior Associates in our top-ranked SEN, Community Care and Court of Protection team to explore this important topic.

The presenters sought to address how family and these other areas of law can overlap through case studies to help family lawyers secure the best outcomes for clients with children who had additional needs and those lacking mental capacity.

  • Financial matters: statutory entitlements and funding.
  • Addressing competing interests while retaining the focus on the welfare of the SEN child or young person.
