£3 million out-of-court settlement after hospital’s delayed diagnosis of neonatal infection caused cerebral palsy

Boyes Turner’s brain injury lawyers secured a £3 million settlement for a child after avoidable delays in treating a neonatal infection caused severe, irreversible injury to his brain. He now suffers from cerebral palsy.

After obtaining our clients medical records, we investigated the standard of neonatal care that he had received. Supported by medical experts’ evidence which confirmed that our client’s disability had been caused by negligent delays in the treatment of our client’s infection shortly after his birth, we pursued a claim for compensation against the hospital.  The case proceeded towards trial, but shortly before the trial was due to take place, the defendant hospital admitted that their staff’s negligent delay had been the cause of our client’s brain injury.

We entered into negotiations with the defendant and reached an agreed compensation settlement of £3million. This will enable our client’s family to pay for a suitably adapted house that meets their child’s needs, and pay for professional carers to help with his additional care.
