£88,000 settlement secured for former fitter with asbestos related lung cancer

Mr F instructed us at age 74 following his diagnosis of lung cancer. It was alleged that he contracted lung cancer as a result of his exposure to asbestos dust whilst working for both British Rail in Inverness and Coventry Press Works in Coventry.

Whilst working for British Rail it was alleged that Mr F worked in the locomotive shed where he spent the majority of his time working in the pits underneath the trains. Mr F described that the air would be thick with asbestos dust and he would be covered in asbestos. He worked beneath men lagging steam engines and it was admitted that he was negligently exposed to asbestos dust whilst employed by British Rail between 1955 and 1961.

Mr F was later employed by Coventry Press Works in Coventry between 1966/67 and 2000/2001 as a Fitter. It was alleged that he was required to repair pipework lagged with blue asbestos and would use a hammer and chisel or screwdriver to remove the asbestos before undertaking any repairs. Mr F also described that he worked on the press shop floor when asbestos lagging was removed from stanchions. It was later admitted that Mr F was negligently exposed to asbestos dust whilst working for Coventry Press Works.

Mr F began to suffer with symptoms of breathlessness in April 2013 and was later diagnosed with non-small cell lung cancer. Mr F instructed Boyes Turner in October 2014 and his claim was settled within 9 months of instructions.

Mr F’s settlement included a deduction for contributory negligence due to his history of cigarette smoking.
