Asbestosis claim settled for £50,000 for former painter and decorator

I was instructed by Mr Peter Hall following his diagnosis of asbestosis. Mr Hall described that he was exposed to asbestos whilst working for Sunderland City Council, Shield Brothers Limited, Austin & Pickersgill and W Crozier & Co.

ASBESTOS EXPOSURE

Mr Hall described asbestos exposure when working for W Crozier & Co as a painter and decorator between 1963/64. He also described asbestos exposure when working for Shield Brothers Limited between 1961/62 for four or five months. Unfortunately, we were unable to identify employers’ liability insurers for these companies and Mr Hall had to accept a discount for these periods of exposure.

Mr Hall further described asbestos exposure whilst working for Sunderland City Council, formerly Sunderland Corporation, between 1959 and 1961/62 and in 1962/63.

Mr Hall alleged exposure to asbestos dust when working on council properties which involved sanding and repainting asbestos sheeting and working in the vicinity of those who were cutting asbestos sheeting. Mr Hall alleged heavy exposure to asbestos dust whilst working for Sunderland City Council.

Mr Hall further alleged exposure to asbestos dust whilst employed by Austin & Pickersgill for five/six months in 1961/62. He described exposure to asbestos dust on the Walkers Naval Yard and alleged that he was exposed when working alongside others who were undertaking work on asbestos lagged pipes. He was also involved in sanding down asbestos sheeting and worked in the vicinity of others undertaking work on the ceilings with asbestos lagging. Mr Hall alleged heavy exposure to asbestos dust whilst employed by Austin & Pickersgill.

ASBESTOSIS COMPENSATION

I obtained a supportive medical report from an expert in asbestos related disease claims. The medical expert considered that Mr Hall’s overall respiratory disability was 20% and this related entirely to his diagnosis of asbestosis.

Mr Hall opted to settle his claim on a full and final damages basis. This means that he accepted compensation for both his current condition and the future risk that his condition may deteriorate and that he may develop mesothelioma or asbestos related lung cancer.

Mr Hall’s claim for compensation was settled without the need to issue Court proceedings.
