Boyes Turner specialist asbestos claims lawyers were instructed by the widow of Mr S who had died from mesothelioma.
Exposure
Limited information was available. Mr S had provided some details of his employment to the DWP which identified potential periods of exposure. The team made enquiries into a number of potential defendants and it was clear that Mr S was exposed to asbestos when he worked for a builder called Eric Cowley. This was a small building company in Chorley which ceased to trade many years ago. Mr S worked as a labourer and was involved in concreting, roofing and hod carrying. The garage ceilings were lined with asbestos sheeting for fire protection. Mr S cut the sheets to fit and helped to install the sheets.
Finding a defendant
We were unable to find a live or dissolved company of this name which was trading at the time of Mr S’s employment. Detailed searches were carried out but no insurers could be found.
Claim
Mr S’s widow Mrs S instructed us following the death of her husband and after establishing that there were no insurers for her late husband’s employment we made a successful claim under the Diffuse Mesothelioma Payment Scheme. Mrs S recovered a substantial amount of damages.
