Court awards a man a five figure sum in compensation after he slipped on an oily substance while bowling during an all-inclusive Turkish family holiday from Thomas Cook.

Boyes Turner secured a five figure settlement for a man who suffered an avulsion injury to his left hamstring when he slipped on an oily substance left on the floor at the hotel’s bowling alley. Hotel staff cleaned the surface of the bowling lane after the accident.

Our specialist team advised the man to bring a claim against Thomas Cook in the UK as a consumer under the Travel Package Holidays and Package Tour Regulations 1992.

Thomas Cook argued that the holiday contract did not specify or set out that claimant would be “reasonably safe” whilst using the hotel facilities, and that bowling did not form part of the services to be provided under the contract or other by the hotel.

Thomas Cook also argued that the claimant unreasonably refused surgery which would have substantially restored him to his pre-accident condition. The Judge did not accept this despite evidence by video link from hotel staff.

The judge awarded the claimant a five figure sum plus costs and refused Thomas Cook’s application to appeal.
