North Thames Gas Board fitter gets compensation after developing asbestosis

Boyes Turner’s specialist asbestos claims team were instructed by Mr Y, who developed asbestosis as a result of exposure to asbestos during this employment with the North Thames Gas Board in the 1960s and 1970s.

Mr Y, who had initially been taken on as an apprentice, worked as a fitter and a technician. He came into contact with asbestos dust in residential and industrial settings. Mr Y had to work on gas boilers which were lagged with asbestos as well as asbestos lagged pipe work. He also worked with asbestos flue pipes, asbestos soffits, asbestos bath panels, and asbestos backing sheets for fireplaces.

Medical evidence was obtained from an independent respiratory physician who assessed the client’s respiratory disability and produced a report detailing the effects the asbestosis was having on Mr Y’s daily life an activities.

The defendant sought to challenge the claim on the basis that there was insufficient exposure to asbestos to have caused the illness. Boyes Turner’s specialist industrial disease team were able to obtain specialist engineering evidence confirming a likely level of exposure to asbestos fibres sufficient to have caused asbestosis. Despite the fact the defendant obtained medical evidence contesting the client’s claim, we were able to negotiate a settlement for Mr Y.
