Pleural thickening claim settled for deceased plumber

Our specialist pleural thickening claims solicitors recently recovered compensation on behalf of Mr K in respect of a claim arising out of his diagnosis of asbestos related pleural thickening.

Mr K was employed by Beeston & Stapleford District Council between 1954 and 1960 and then for Broxtowe District Council between 1975/76 and 1976/77 as a plumber. He undertook repairs to council houses. This involved repairing, maintaining and renewing asbestos rainwater goods. In addition, he had to lag heating cylinders with asbestos which he had to mix up by hand with raw asbestos paste and water. We pursued Broxtowe Borough Council who retained the liabilities of Beeston & Stapleford District Council and Broxtowe District Council.

He then became employed by Nottingham City Council between 1981/82 and 1995, again as a plumber. He carried out similar work as before. He also had to maintain corrugated asbestos roofs on pre-fabricated housing.

Sadly Mr K passed away during the claim as a result of a condition unrelated to his pleural thickening. The claim was therefore taken over by his widow, Mrs K.

Court proceedings were issued and engineering evidence was obtained in relation to the levels of asbestos exposure Mr K was likely to have been exposed to, and also regarding the various legislation and knowledge at the time of his exposure.

The claim was listed for a 3 day trial at the Royal Courts of Justice in London. We obtained witness evidence in support of Mrs K’s claim who were to attend trial along with the expert engineer.

The defendants accepted an offer that we had made just weeks before the trial and the trial was accordingly cancelled.
