Rachel Brown is a Senior Associate – Chartered Legal Executive, CILEx Litigator in Boyes Turner’s Dispute Resolution and Debt Recovery teams. With more than 25 years of experience, she advises businesses, public sector organisations and local authorities on a wide range of commercial dispute and litigation matters. Rachel has particular expertise in contractual disputes, cross-border disputes and matters involving local government liability order recoveries, providing practical, strategic advice focused on achieving effective and commercially sensible outcomes for her clients.

Rachel regularly manages matters involving contractual and/or cross-border disputes and defended claims. She assists clients with pre-action strategy, settlement negotiations, court proceedings from issue right through to trial and enforcement action, helping them recover monies owed and resolve disputes as efficiently as possible. Her work often involves coordinating complex recovery programmes, dealing with contested claims and advising on the practical steps required to achieve successful outcomes.

Rachel specialises in cross-border disputes acting both for client’s who are outside of the UK and in proceedings against parties who are outside of the UK. She also specialises in complex commercial litigation e.g. contractual disputes relating to business advisory services, software and IT disputes, loan agreements and personal guarantees are also areas she specialises in.

Rachel is known for her determined, practical and results focused approach. Her ability to cut through the issues and identify the most effective course of action is what her client’s value about her particularly as she remains focused on achieving recovery where possible. Drawing on more than 25 years of experience, Rachel combines technical expertise with a clear understanding of the commercial realities facing her clients, providing straightforward advice throughout. Rachel is experienced in managing disputes through all stages of the litigation process, including proceedings in both the High Court and County Court. She also has a strong track record of resolving disputes through mediation and settlement negotiations, helping clients achieve commercially effective outcomes while minimising the disruption, cost and uncertainty often associated with court proceedings.

Rachel's key cases

A few of Rachel’s key cases include:

  • Acting for a business advisory company in issuing and pursuing a claim in the English Courts in excess of £1 million against a company based in the UAE. Proceedings are progressing through the courts.
  • Obtaining judgment in the English Courts for a business advisory company in respect of unpaid expert services fees against a company registered in Luxembourg and trading in New York and securing a favourable settlement following the registration and enforcement of the judgment in the United States.
  • Acting for a finance company in relation to an outstanding loan due under a loan agreement and both corporate and personal guarantees against 4 Defendants, including a UK Company, 2 companies registered in the Isle of Man and an individual domiciled in the Isle of Man. Proceeding were issued in the English Courts for approx. £250,000 and judgment has been obtained against all 4 defendants.
  • Acting for a large financial technology company in relation to a contractual dispute they have with a customer company. After pre-issue correspondence, it was not possible to reach a resolution with the defendant and so proceedings were commenced for approx. £160,000 and the matter is progressing through the courts.
