Claim settled after a delay in diagnosis of Ewings sarcoma tumour of the spine

We obtained a six figure sum in compensation for a 17 year old boy following a delay in diagnosis of a Ewings sarcoma tumour of the spine.

Delay in diagnosis by hospital

The boy had been to see Accident and Emergency staff at the defendant hospital on three separate occasions over a short space of time and on each occasion he was sent home. On his fourth visit, he was admitted for further investigation which is when the tumour was finally diagnosed. The delay in diagnosis caused him to become paraplegic following surgery and the boy has been left with significant neurological deficits.

Compensation claim

The boy obtained advice from Boyes Turner’s medical negligence team and a compensation claim was brought against the hospital for the delay in diagnosis of the tumour.

Expert evidence was obtained from six experts, including a neurosurgeon and an oncologist. Liability was partly admitted by the Hospital following the service of a Letter of Claim. A six figure settlement was negotiated by our experts following the commencement of formal court proceedings against the Hospital.

There was no cost to our client in bringing the claim.
