Chloe Scarr

Chloe Scarr is an experienced Associate Solicitor in Boyes Turner’s Community Care and Court of Protection teams.

Chloe is skilled at building good working relationships with clients and case managers. She can explain complex legal issues in straightforward language, ensuring that her advice is comprehensive and clear. She is passionate about providing a high-quality service and achieving positive outcomes for clients. As a health and social care specialist, Chloe supports clients affected by life-changing and often life-limiting injuries. Chloe guides clients through complex eligibility criteria and statutory assessments to achieve the best possible outcome. Often this means the client enjoys a better quality of life due to an increase in the care and support they receive.

Chloe works tirelessly to ensure that assessments and provision offered by statutory bodies are lawful, reasonable and make a difference to the client’s life. Chloe has run lectures and training courses across England for other legal professionals, charities and financial advisers on social care funding, healthcare funding, safeguarding vulnerable adults and Court of Protection health and welfare applications.  

She has also acted as a carer and as an Attorney (both types) for a family member with Alzheimer’s disease, so has a deeper level of understanding when speaking with clients in a similar position.   

Chloe’s specialisms span three main community care law areas:

Social care funding

• Care Act 2014 eligibility and assessment, personal budget negotiations, care planning, financial assessment and direct payment disputes.
• Challenging arbitrary funding decisions including reductions in the level of support provided without proper review, Disability Related Expenditure and Disabled Facilities Grants decisions.
• Deprivation of asset disputes.
• Children’s social care matters including transition from children’s services to adult services.

Healthcare funding

• Hospital Discharge.
• Children’s Continuing Care and NHS Continuing Healthcare eligibility, assessments and appeals.
• Personal Health Budget eligibility and challenges to insufficient funding to meet assessed needs.
• Section 117 Aftercare funding disputes & CPA planning.

Court of Protection and Mental Capacity Law

• Lasting Power of Attorney and Deputy applications (contested and non-contested).
• Applications and litigation in both financial and health and welfare Court of Protection proceedings, including family disputes and concerns over Attorney and Deputy suitability.
• Safeguarding matters covering issues such as financial abuse, disputes relating to who a person should have contact with and where that person should live.
• Mental capacity assessments and best interest processes including representation at best interests meetings.
• Deprivation of Liberty Safeguards.
