Boyes Turner’s medical negligence team secured a settlement of £221,000 for a client whose spinal nerves were injured as a result of delayed diagnosis and treatment of a haematoma (bleeding) and a clot following surgery on her spine.
She suffered damage to her spinal nerves leading to paralysis in her legs and faecal and urinary incontinence. Over time the function in her legs recovered but she was left with relatively poor mobility, muscle spasm and difficulty with fine finger movement.
After investigating the care that our client received, we sent a detailed letter of claim to the defendant hospital and began court proceedings soon after. A defence served on behalf of the hospital denied all allegations of negligence. We pursued the case towards trial. The case was strongly contested, with complex arguments arising from the differing views of the experts instructed by each party about the standard of care, and about whether our client’s disability would have been avoided if correct care had been given. The case concluded with a negotiated out-of-court settlement of £221,000 for our client which reflected the ‘litigation risks’ arising from the experts’ differing views.
