Boyes Turner’s accident compensation lawyers secured a £40,000 compensation settlement for a client who was injured in a road traffic accident whilst on holiday in Zante, Greece. Our client was on a rented moped and was stationary waiting to turn left into his accommodation when he was hit by another rented moped, driven by the defendant who was also British. Our client suffered a serious degloving injury (needing skin grafting) to his leg.
Claiming compensation for injury after an RTA in Greece – under Greek law
Although both the claimant and the defendant were British, the insurers who covered the defendant’s liability for the accident and our client’s injury were based in Greece. The claim had to be brought under Greek law and much of the evidence, including the standard police report of the accident, was missing, unreliable or factually inaccurate.
Overcoming unreliable evidence by proving our client’s case
The defendant denied that he was to blame for the accident. His insurers attempted to ignore our communications.
We issued court proceedings and overcame the defendant’s unsuccessful attempt to evade service of the proceedings by proving to the court that he was resident in England when the proceedings were served, using Facebook and other social media.
We used photographs from witnesses to prove that the local (Zante) authority ‘certification’ about the existence of road markings, which were key to winning the case, was not true. We overcame the defendant’s expert’s suggestion that our client had caused the accident. We also successfully disputed the defendant’s request for unnecessary accident reconstruction expert evidence, as we had proven on the evidence our client’s entitlement to compensation and both drivers had clear memories of the accident.
Time limited settlement offers led to full compensation
When the insurers ignored our attempts to agree a method of valuing the claim, as is needed in international cases, we pushed the claim forward by making time limited settlement offers. The case settled at £40,000, giving our client full value compensation for his injuries.
