Boyes Turner’s personal injury solicitors secured a £315,000 settlement and funded rehabilitation for a young man who was seriously injured when he was crushed between two parked cars which were hit at speed by the defendant driver’s car.
Our client’s car broke down on his way home from work. He called for assistance from a co-worker who lived nearby. His colleague arrived and positioned his vehicle head to head with our client’s car at the side of the road, so that they could jump start the broken-down car. Both cars were stationary and the co-worker’s car had its hazard lights flashing.
Whilst our client was standing between the parked cars, another vehicle which was being driven by the defendant at speed hit the rear offside of our client’s car, shunting it into his colleague’s car and crushing our client between the two vehicles.
Crush injury causes permanent disability
Our client suffered a severe crush injury to his leg with arterial damage from a traumatic rupture of the popliteal artery. He also suffered a deep laceration to his head which hit the car bonnet during the collision. He required a three-week hospital admission and underwent multiple surgical procedures, including popliteal artery bypass, fasciotomy, muscle debridement and skin grafting, as well as closure of his head wound.
His injuries left him permanently disabled with extensive scarring on both thighs (from skin grafting), altered sensation in his lower limb and foot, and ongoing pain which is worse on exertion. He will need further treatment, including nerve blocks, neurolysis and skin graft revision surgeries. As a result of his disability, he is hampered in running his business and is disadvantaged on the labour market.
Funded rehabilitation prioritises the injured person’s recovery
We served a letter of claim on the defendant driver and secured Rehabilitation Code funding from the driver’s insurers for early rehabilitation to maximise our client’s recovery. This enabled us to instruct a case manager to provide an immediate needs assessment and arrange for our client to receive intensive rehabilitation, including custom-made orthotics, intensive physiotherapy, pain management and neuropsychological support.
£315,000 compensation settlement without court proceedings
We secured an admission of liability and served a schedule of our client’s loss with supporting evidence and then entered into settlement negotiations with the defendant’s insurer. This resulted in a £315,000 negotiated settlement for our client, which more than doubled the insurer’s initial offer. Our client’s compensation settlement was achieved without the need for court proceedings.
We are now representing our client’s passenger and the colleague who assisted him at the roadside in similar claims for their own injuries arising from the same collision.
