Boyes Turner Specialist Personal Injury Team recovered £90,000 for a father of two injured whilst fitting windows on a building site in an accident at work.

The claimant was an experienced window fitter and his employer was a specialist window supplier contracted to work on a construction site. The claimant was required to fit windows to the first floor of a construction site building. There was no staircase in the premises and the claimant and his colleagues accessed the first floor by means of ladders placed between floor joints.

Reports were made by employees to the employer that the system was an unsafe system of work but no action was taken by the employer. On the day of the accident The claimant was coming down a ladder carrying a window when he lost his footing and fell to the ground. He sustained a ruptured Achilles tendon and required months of hospital treatment and physiotherapy. As a result of the accident he was unable to return to work which involved heavy lifting and climbing ladders. He suffered loss of earnings and faced an uncertain future because of his work injuries. The accident on the construction site was notified to his employer.

The claimant instructed our specialist team to make an accident at work compensation claim. Initial pre-action correspondence did not result in settlement and proceedings were issued. A further offer was made by the claimant which was accepted three months after service of proceedings.

Following the accident the employer adopted a safe system of work and to avoid further serious injury to its employees.
