£125,000 compensation settlement for assaulted care worker

Boyes Turner’s personal injury solicitors secured a £125,000 settlement for a residential care worker who was violently assaulted by a 16-year-old resident at the care home where she worked. She suffered concussion, an injury to her vestibular system (affecting balance, coordination of movement, and spatial awareness), and post-traumatic stress disorder (PTSD).

Following the assault, our client was unable to return to care work and, after an unsuccessful attempt at alternative work, she returned to her home country where she received treatment for her psychological and vestibular injury.

We pursued a claim for our client against her care home employers on the basis that they were aware of the teenager’s increasingly violent and sexual behaviour towards our client. They denied liability and argued that they had trained our client in a defensive manoeuvre to counter any assault, however, it was our client’s case that this manoeuvre was known to be ineffective given the discrepancy in our client’s and the tall teenager’s heights.

We issued proceedings and obtained a court order for specific disclosure of the care home’s daybooks, night books, minutes of meetings and other documents containing information relating to the teenager. When the documents were disclosed, they contradicted the employers’ defence and confirmed that our client’s employers had long been aware of the teenager’s behaviour and the significant danger to our client. With a trial date approaching, they finally entered into negotiations which resulted in a £125,000 compensation settlement for our client.
