Boyes Turner acted for a young woman who was hit by a Range Rover as she reversed her own car out of a friend’s drive. The force of the road traffic accident (RTA) impact jammed the doors of her car shut and she was trapped for several hours whilst the emergency services tried to free her.
The young woman was in substantial, immediate pain and suffered soft tissue injuries, a wedge fracture of her thoracic vertebrae and a whiplash injury to her cervical spine together with psychological consequences. She was taken to hospital and was admitted for observation. Investigations were carried out due to a concern that she has suffered a spinal injury but she subsequently discharged to the care of her family.
After coming out of hospital the young woman continued to suffer as a result of her spinal injuries and was recommended to undergo physiotherapy and cognitive behavioural therapy treatment which she did. However, it is likely that her symptoms will continue indefinitely.
She then started a spinal injury compensation claim using another firm of solicitors. In preparing the case they tried to rely on expert who did not appreciate the severity and long term effects of the accident. She subsequently switched to Boyes Turner specialist personal injury solicitors and when we took the RTA claim over another expert was instructed immediately and explored the full nature and extent of all of the claimant’s injuries.
The case progressed to formal court proceedings and liability was admitted. As part of the settlement we sought and obtained a significant interim payment for a residential treatment programme. There was also a loss of earnings claim as her career progression was delayed.
The claim was eventually settled for just under £100,000.
