Our client was involved in two road traffic accidents within a short period of time. The circumstances of both accidents were similar; our client’s vehicle was hit in the rear. Liability was admitted in respect of both accidents.
Our client sustained overlapping symptoms in both accidents, namely a strain of her cervical and lumbar spine, headaches, anxiety and depression. Our medical experts, an Orthopaedic Surgeon and a Consultant Psychiatrist, had to apportion blame between the defendants and comment on what symptoms were attributable to the first accident and what symptoms were attributable to the second one. The attribution of causation was evenly split between the two road traffic accidents.
Our client had a claim for loss of earnings as she was unable to carry on with her work because of the injuries sustained. However causation in this regard was an issue and the defendants insisted on obtaining their own medical evidence. The matter settled out of court for £15,000 in respect of each accident.
