Starting your asbestos mesothelioma claim

To make a claim for an asbestos related disease, an initial meeting is always provided free of charge. At that meeting, we will discuss how to fund the mesothelioma claim. Mesothelioma FAQs

Mesothelioma is a tumour which affects the mesothelium, most commonly in the lining of the lung, but can also affect the abdominal cavity, heart, or testes. Mesothelioma is almost always caused by exposure to asbestos and has a long latency period of typically between 20 and 50 years. The disease is often associated with weight loss combined with night sweats and shortness of breath, especially if it is pleural mesothelioma.

Symptoms of mesothelioma are often similar to that of other asbestos related disease. These common asbestos related disease symptoms include chest pain, shortness of breath, fatigue and tiredness, and a persistent cough. Other symptoms include loss of appetite, unexplained weight loss and night sweats.

The amount of compensation that can be awarded in a mesothelioma case differs in every case and is based on the individuals’ circumstances. In a successful case, general damages are awarded for the asbestos related disease itself and the accompanying pain, suffering, and loss of amenity.

There are time limits within which mesothelioma claims can be pursued. You have three years from the date it can reasonably have been expected that you ‘knew or ought to have known’ that your condition may be associated with your asbestos exposure within which to issue court proceedings.

If someone affected by asbestos related disease dies within three years of this date, then the personal representative of the estate has three years from the date of death within which to issue court proceedings. However, there are some circumstances where exceptions can be made (as the court does have a discretion to disapply the time limit), so please do contact us so that we can advise you appropriately.

However, it is often possible to secure an admission of liability and an interim payment quickly, within a matter of weeks, depending on the strength of the case.
